关于“见危不救罪”的义务来源和刑法学思考

摘要

见危不救是否定为犯罪，必须在对见危不救准确界定和分类的前提下，通过对道德基础、人性基础、价值基础义务来源分析比较，对刑法学中立法意义上的犯罪本质之规定性、刑法因果关系、刑罚目的和价值的剖析，坚持具体问题具体分析的科学态度来对“见危不救罪”进行全面的分析。

Abstract
