 摘要：醉酒架驶机动车和在城区飙车，是人们深恶痛绝的两大“马路杀手”。刑法修正案(八)首次将飙车、醉驾列入犯罪行为，并规定了量刑标准。2011年5 月 1 日,刑法修正案(八)正式实施。其中规定的“醉酒驾驶机动车,不管是否造成后果,都将按照‘危险驾驶’定罪,处以拘役,并处罚金。”在社会上引起了不小的反响。作为一个学习法律，热爱生活的在职学生，试图从法律的角度分析看待“酒驾入罪”。

Legal Thoughts on drink driving conviction dispute
 Abstract：In May 1, 2011, the criminal law amendment ( eight ) the formal implementation. 引言：
刑法修正案(八) 提出的酒驾入罪，自从实施到社会各界对“醉驾入罪”的争议，从最初是否应该犯罪化推向醉驾行为能否一律入罪的高峰。笔者对于全国酒驾入罪实施以来，受到惩罚的人们，深表遗憾，笔者认为，分析相关刑法规范和刑法理论，可以更好地看待酒驾入罪这一问题。 文章第一章叙写酒驾入罪的提出；第二章叙述酒驾入罪引发的社会各界的争议；第三章从法律角度分析讨论“酒驾是否一律入罪”；第四章综合探讨酒驾入罪。
