分析新民事诉讼法所要完善的方面

摘要

中国民事诉讼法学研究会每年的年会较为集中、全面地反映了一段时期内民事诉讼法学的研究热点、重点与难点。从某种意义上讲，它是我国民事诉讼法研究总体水平的一种体现。其中可以发现新民事诉讼法施行一年多来所呈现出的变化、发展以及不足。本文通过对新民事诉讼法中存在的问题进行了分析研究，针对其在检查制度、适用鉴定意见以及证据规定上存在的问题给与了一些改善建议。通过完善举证程序、质证程序以及确立认证规则，公开鉴定意见自由心证来使我国的民事诉讼法内容更加完善和有效化。

Abstract

The annual Chinese civil litigation law research annual meeting is more concentrated, which reflect the research focus for a period of time in the civil procedure law, key points and difficulties. In a sense, it is a reflection of the overall level of the Civil Procedure Law of our country. These changes can be found in more than a year of the implementation of the new civil procedure by showing the development and shortcomings. Based on the existing problems in the new civil procedure law are analyzed, according to the inspection system for expert opinion and evidence rules on issues and give some improvement suggestions. By perfecting the proof procedure, quality certification procedures and the establishment of Certification Rules, contents of civil public opinion identification procedure of free proof to make our more perfect and effective.
