摘要

夫妻财产制度是主要调整夫妻间财产关系的重要法律制度，其制度的完备程度，直接决定了家庭的和谐、民事交易的安全性以及社会的稳定。笔者结合我国现行的《婚姻法》以及相关司法解释规定，对其中规定财产归属关系的法律条文进行了深入的剖析，指出了我国夫妻财产制度存在一些问题，而这些又主要是在规定夫妻法定财产制和约定财产制方面内容中所存在的立法缺陷与不足所导致的，并提出完善此制度的一些想法和措施。

Title    Matrimonial  Property System and Its Perfection

Abstract:

The matrimonial property system is the important legal system which mainly adjusts the property relations between husband and wife. The completeness of the system directly determines the harmony of family, the security of civil transaction and the stability of society. The author analyzes the legal provisions which stipulate the ownership of property, and points out that there are some problems in the system of matrimonial property in China, which are mainly based on the stipulation of the legal property system of husband and wife And the contents of the agreement property system in the existing shortcomings and shortcomings caused by, and put forward to improve the system of some ideas and measures.
