传统法律文化的社会解读

摘  要

中华浩瀚五千年的文明史蕴涵着丰富的传统法律文化。中国传统法律文化源远流长，从上古传说时代到清末修律这个时间跨度内，历数千年而绵延不绝。一直以来，研究中国传统法律文化的著作颇多，许多学着专家从多个角度去研究解说中国传统法律文化，而瞿同祖先生的《中国法律与中国社会》则以其深刻独到的见解、以其社会学等多学科背景，特别是以其别具一格的篇章体例向我们展现了自汉至清的两千余年间中国封建法律的演变，是一部关于传统法律文化以及法律史的重要著作，更是一本具有社会学意义的法律史学著作，把两千多年的传统法律作为一个整体从而去放到古代社会这个巨大背景中加以研究剖析，法律与社会具有密不可分的联系，它不但要维护当时社会制度、道德和伦理等价值观，同时还反映了特定时期的社会结构。

本文对瞿同祖先生的《中国法律与中国社会》进修了传统法律文化的社会解读，首先对该书及作者做了简要介绍，接着介绍了《中国法律与中国社会》写作背景，然后对该书主要内容进行了透析，特别是儒家与法家对传统法律文化影响的比较和家族、阶级、礼法与法律直接的作用进行了详细评析，并在此基础上引出了笔者自己的几点思考，最后得出了纵观中国的法治建设中国传统法律文化在现今法治中国的映射，我们应该科学地正确地认识中国传统法律文化的价值， 在建设法治国家的过程中取其精华去其糟粕，让我们的法治文化源远流长的结论。

ABSTRACT

The  history of five thousand years of civilization contains rich in traditional legal culture.Chinese traditional legal culture has a long history， from ancient times to the late Qing law this time span， thousands of years and endless. All along Chinese of  traditional legal culture of many book，many experts to study Chinese inte-rpretation of traditional legal culture from the point of view of  law and China .Mr. Qu Tongzu "and" Chin-ese society withits profound insights， the sociology and other disciplines background， especially in the style of the text have a style of one's own to show us the evolution of Chinese feudal law from Han Dynasty to Qing Dynasty more than 2000 years， is one of the most important works on the traditional legal culture and legal history， it is a significance of legalhistory book society， the traditional law for more than two thousand years as a whole and to make studies on the analysis of the large background in ancient society， law and society are inextricably linked， it is not only to maintain the social system， the moral and ethical values， but also reflects the social structure in a particular period.

This paper to Mr. Qu Tongzu's "law and society" Chinese China study social interpretation of traditional legal culture， the book and the author firstly introduced briefly， and then introduces the"law and society" China China writing background， and then analyze the main contents of the book，especially a detailed analysis of the Confucian and Legalist school on the influence of traditional legal culture， class， and family law and the law of direct action， and on this basis， the author raisessome thinking of their own， finally comes to the conclusion that the construction of the rule of lawthroughout the Chinese China traditional legal culture in modern rule of law Chinese mapping， we should scientifically correct understanding of the value of the traditional legal culture China take the essence， in the process of building a country under the rule of law to its dross， so that the rule of law culture has a long history of our.
