网络募捐行为的法律规制

摘  要

互联网的快速发展，带来了社交平台的发展，大大缩短了人与人交互影响的时间和空间。个人网络求助寄生于互联网，平台多样，方式灵活，是很好的补充。虽然《慈善法》已经制定，规定个人求助不在慈善法规制的范围内，但是对于个人求助的研究以及法律规制的讨论可以继续。该文以罗一笑事件为引子，以新慈善法理念和相关法律法规制度为基础，同时在阅览相关文献的前提下结合当前中国个人网络求助现象深入思考，分析罗一笑事件所引发的法律问题兼浅论我国个人网络求助行为的法律规制，提出一些粗陋的观点和建议，制定个人网络求助诈骗犯罪，明确网络个人求助的法律主体；加大个人求助平台信息化建设，建立全国性的公共网络服务平台，进行线上线下交互配合，促进我国慈善事业的长足发展。

The Legal Regulation of Personal Network for Help—— Caused by “Yixiao Luo” Incident

Abstract 

The rapid development of the Internet, bringing the development of social platform, greatly reducing the interaction between people and the time and space. Personal network help parasitic on the Internet, the platform diverse, flexible way, is a good supplement. Although the "charity law" has been enacted, the provisions of personal help is not within the scope of charitable law, but for personal help and legal regulation of the discussion can continue. Based on the concept of new charity law and the related laws and regulations, this paper is based on the study of the relationship between the new charity law and the relevant laws and regulations. At the same time, under the premise of reading the relevant literature, this paper combines the current Chinese personal network for help and deeply analyzes the legal problems caused by the Luo smile event. On the legal regulation of personal network seeking behavior in China, put forward some crude views and suggestions, set up personal network to help fraud, clear the network of personal help for the legal subject; increase personal help platform information construction, the establishment of a national public network services Platform, online and offline interaction, and promote the rapid development of China's charity.
